The rules for building on Capybara.

Capybara (a product of Terminal Labs Inc.) is free developer tooling to make games playable. The short version:

1. Your game is yours. You own your games and their content; generating or hosting with Capybara gives you no rights in anyone else's IP.
2. Use the service responsibly. No abuse, security probing, illegal content, or circumventing limits. Keep API keys secret.
3. Reliable dev tools, free. We follow industry standards for availability and uptime, and we keep shipping new features over time.
4. You are responsible for what you publish. Your games and your players' privacy are on you.
5. As-is, with limited liability. See sections 8 and 9.

Capybara developer tools are owned and operated by Terminal Labs Inc., a company incorporated in Canada. When we say “we,” “us,” or “our,” we mean Terminal Labs Inc. When we say “you,” we mean the person or entity using Capybara.

By creating an account, signing in, or otherwise using Capybara, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

Capybara provides backend tools for games: player sign-in, saves, multiplayer rooms, publish URLs, project API keys, an integration brief, docs, and an analytics dashboard. The tools are currently free. We follow industry standards for availability and uptime so your games stay playable, and we keep evolving the platform with new features over time.

Provide accurate account information and keep your credentials secure — you are responsible for activity under your account. Project API keys are read-only credentials for your own analytics, players, and brief endpoints: keep them secret, rotate them with the dashboard's revoke-and-recreate flow, and tell us promptly if you suspect unauthorized access. Notify us if you suspect a breach.

You agree not to:

• Violate any applicable law or regulation.
• Publish or distribute content that infringes another person's copyright, trademark, privacy, or other rights.
• Upload malware, attempt unauthorized access, or interfere with the platform or other users.
• Abuse the service — including circumventing rate limits, reselling access without permission, or using games to distribute illegal, abusive, or deceptive content.

We may suspend or terminate accounts that violate these rules.

• Ownership: as between you and Terminal Labs Inc., you own your games and their content. Nothing here transfers ownership of Capybara's platform, SDK, APIs, or branding to you.
• License to operate: you grant us a worldwide, royalty-free license to host and process your project data and game traffic only as needed to provide, secure, and support the service.
• SDK license: you may use and distribute the Capybara client and SDK modules as incorporated into your games. Don't extract or resell them standalone.
• Your players: you are responsible for your published games, their content, and your players' privacy — including any notices, consent, or age-appropriate handling the law requires.

You may stop using Capybara at any time. We may suspend or terminate access for breach, legal reasons, or service discontinuation. Deleting a project removes it and its API keys from the platform; game configs already provisioned on the game server remain until you ask us to remove them. Ownership, disclaimer, and liability sections survive termination.

To the fullest extent permitted by law, Capybara is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Terminal Labs Inc. and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunities. Total liability for any claim is limited to the greater of (a) amounts you paid us in the twelve months before the claim, or (b) one hundred Canadian dollars (CAD $100).

These Terms are governed by the laws of Canada and the province in which Terminal Labs Inc. is incorporated, without regard to conflict-of-law rules.

We may update these Terms from time to time. Material changes will come with reasonable notice — via your account email or a prominent notice on this site. Continued use after the effective date means you accept the updated Terms.
